OP is a MINIMUM WAGE worker with little to no savings. But you insist that she waste time and money on legal action against somebody with MORE wealth and institutional power to retaliate if she tries anything by herself.
You advocate that she sues him through the bourgeois legal system for her own personal, individual gain. Potentially putting her fellow workers out of work, and despite the legitimacy of her grievance, do you think the other employees will be so understanding? Maybe a few, but for sure some will be alienated and will be pushed towards reactionary conclusions on the side of the boss because of the threat to their livelihood. The solution I have brought up utilizes an institution of which provides the GREATEST protection a worker can have as it currently can exist in the capitalist system itself.
Is trying to unionize a risk? OF COURSE. When did I ever said it wasn't? The worst case scenario of trying to unonize is that she gets fired out of a shitty fucking job in a climate where the same minimum wage jobs are plentiful. The best case scenario is that she builds SOLIDARITY and CLASS CONSCIOUSNESS. You know, the lowest bar possible for organizing workers and the base for something more.
The boss can try and fire one individual pursuing legal action, but he can't fire half or more of his workforce if they unionize without severely compromising his bottom line. HELLO? Strength in numbers. It is ultimately up to OP, but I believe their two options to prepare to leave or start an effort to unionize.
