Among the accusations made against Lula in the CW saga, Leo Pinheiro's were the most important. He had been a friend a Lula's and let him routinely use the country home which was teh centerpiece of his second conviction, and seeing as he was a high executive of a public contractor, CW drew an accusation of bribery between these facts. Mind you, it's also a fact that Lula never owned that home, and in fact it has been on sale for months now and Leo is the proprietor, which makes this a strange bribe which somehow never reached the bribed party. Further, CW also never demonstrated any case that contractor being suspiciously favored by PT governments, which makes this bibe strange twice over, but the worst elite in the world was more than willing to overlook that. In any case, Leo Pinheiro's testimonies were a prime example of CW's routine practice of harassing and threatening witnesses so their accusations, made under plea bargain deals, would say what CW wanted them to say. Leo, being Lula's friend, initially testified against any malfeasance on the latter's part, but CW leaned on him constantly and made him change his official testimony twice in order to nab their big squid trophy (and having the sentence hanging over him cut by 70% thanks to that), and that ridiculous non-bribery is the best they could come with. Needless to say, Leo became synonymous with betrayal to anyone who was both aware of the real dealing of CW and against this crime against democracy. And by the way, Leo's son-in-law was named head of one of the big State-owned banks, Caixa Econômica Federal, just a week into Bolsonaro's term. This is a "payment for services rendered" if there ever was one, but then again, next to Moro becoming a ("super") minister of the man who only won because Moro himself arrested the world-be winner, this pales in comparison.
I bring this up because it has just surfaced that this past May, Leo wrote a letter taking his entire testimony back. This might be part of the juridical evidence to which Lula's legal defense had been denied access for years, which has been November 2020 and finally ratified February 2021.

I have mentioned inthe past how CW's "innovations" violated
a lot of basic paradigms of the Brazilian juridical system and those of modern, democratic law. I'll try not to go on for too long on them.
In the first category, the biggest problem is no doubt the plea bargain, one of the cornerstones of the American legal system. It's a common law system, unlike that of most of the world today which is some variation of Roman law, to which such mechanism is completely alien, but of course that doesn't necessarily preclude those systems from adopting it. In Brazil's case, plea bargains had been used on an
ad hoc basis until 2013, when they were properly codified into law as part of a bill aimed at combating criminal organizations. Not coincidentally, 2013 in when CW began in March, and this law was ratified in August despite having been first proposed in 2009, so it's quite possible that the anti-corruption demands which were central to public debate back then contributed to this in order to let CW supposedly clean the country. Back then, anti-corruption was a cause the left was vocal about, until that year's fateful June when the right co-opted the protests. In any case, plea bargains are something which, ironically, work better in an
ad hoc basis than as a properly codified mechanism, because it necessarily introduces a possible conflict of interest: it provides a motive for the authorities to cause a sentence "inflation". If used with any regularity, plea bargains provide the authorities an extremely easy, and extremely anti-democratic, tool to coax the accused into confessing to whatever simply by raising sentences. This is a perfect example of a perverse incentive, because it provides no advantages whatsoever, only problems. Besides the tendency of sentences to crawl upwards, this fosters the creation of a police State, and that's even before we get to profit motive of private jails and whatnot. It's debatable how much the plea bargain is a cause and how much a consequence of the trainwreck that is the American legal system, but it is a pilar of it nonetheless. And Moro wanted to bring that here, after greatly popularizing it during CW. Cue what I say about our elites copying the bad things and ignoring the good ones about "the big brother up north".
In the second category, we have the presumption of guilt in Lula's case (enabled by a STF judge who flat-out said that corruption cases did not need the crime to be proven, and proving just the opportunity for the crime was enough) as the biggest offender. There was also Moro colluding with the prosecution, which exacerbates a crucial flaw with the Brazilian system, that of the same judge conducting both the investigation and the trial, which introduces bias into the process. Ideally, investigation, trial, prosecution and defense are done each by a different party, whereas Moro accumulated all 3 first roles. Only recently has the figure of the "juiz de garantias" has come to the fore, precisely because of the mess that CW started, and it's still not the full separation of investigation and trial to different judges but rather an auxiliary judge who keeps tabs on the one doing the investigation and trial. The law which mandates this was approved in December 2019 as part of Moro's "anticrime pack", tho I have no idea whether he made this contribution or Congress did, but my friend and your Luis Fux (pro-CW and a severely overlooked accomplice of the 2018 disaster) struck that law down less than a month later, on grounds of lack of funds. I'm fairly sure such an argument is blatantly outside of the remit of the constituional court, but hey, no surprises there. Still, it's a big step, and the only other American country still not to enact this mechanism is, ironically, Cuba. Sadly, existing socialism had a notorious penchant for extrajudicial measures and disregard for due process, a heritage of the adversities of the early Soviet State. Another regressive measure common in existing socialism was the use of secret evidence, and as it happens, CW had that too. As I mentioned above, only this year has Lula's defense team finally been allowed to see all the evidence, amidst the dismantling of CW, and I think, but can't confirm, that this letter by Leo Pinheiro was part of it.
Finally, I'd like to point out that, while the problems of the first category can be excused on grounds of plea bargains being an alien paradigm, the problems of the second category are both glaringly obvious and inexcusable, yet the entire Brazilian juridical system turned a blind eye despite the incessant accusations. It's another thing which shows how the entire Brazilian establishment bears responsibility for both the death of our democracy and the genocide. These were the result of impunity, not just in a criminal but in a broad sense as well. We let evil persevere for too long.

Saying "foreign investment" is a thought-terminating cliche in Brazil, as something nearly sacred which must be sought at all costs. It's particularly pernicious because, truth be told, foreign investment is, as far as i can see, an absolute necessity for national development post-WW1. The ones who did so before then (USA and the European powers) had accumulated a lot of capital from colonialism, merchants etc., a luxury the others didn't have. The main case of the latter type, no questions asked, is the USSR itself, somewhat ironically. The others were Singapore, South Korea, Taiwan, Finland, Hong Kong (maybe Macao too?), Iceland and Ireland (Canada, Australia and New Zealand, for most intents and purposes, were outgrowths of the UK when they underwent development). I don't know much about the latter 2, I confess, but all the others had a massive and deliberate State-led effort to develop, aking to what we call "projeto de nação. This process happened more organically with the pre-WW1 powers, whose industrialization was a "natural" side effect of their natural imperialist ambitions.
So historical examples hint that we need a lot of foreign investment
plus a State-led national project. A cursory look at our elite shows an obsession with the first factor and a complete disinterest, punctuated with open rejection, of the second one. The very portrait of a comprador elite.

This is why the countries which underwent development under capitalism, specially after WW1, add up to a rather small population, and the West strongly supported the development of most of them because of their geopolitical importance. By contrast, in the rest of the developing world, any people getting funny ideas about industrializing were swiftly ruined. Their old ruling classes were replaced with people strongly motivated to develop and industrialize their countries. Both had crucial foreign invertment and both had the national project which Brazilian elites have always shunned. Our elite may or may not have the skill to properly develop the country, but it's irrelevant so long as they don't have the will to do so, and they have always been downright inimical to this. A look back at our modern history is pretty much a continuous series of struggles of different groups with the traditional elites to industrialize and modernize the country, and all of them, of course, ended in the latter's victory and a return to our baseline banana republic status.
So then, our elite is an obstacle to our development. Getúlio tried a mixture of rewards and punishments, bribing, cajoling and generally taming it into coming along but obviously did not outright opposed it, and we know what happened to him. The development-minded during the military dictatorship were fully aligned with it as well as with the West in general and attempted to encourage them to join the effort, and it went nowhere. Now that I think about it, these two attempts at development mirror those which took place elsewhere in the world before WW1 and afterwards, respectively. Getúlio applied several types of measures towards the traditional elites other than open animosity in order to craft a nation like the old powers, and, afterwards, the more enlightened in the military tried to build up seemingly on a naïve assumption that national development was a natural process which the elite would join if only they could initialize it. Clearly, both failed, and I can only see a deliberate commitment to underdevelopment in the part of our traditional elite as the common factor.
There's also the matter of the PT era as the next episode of this series of struggles, but honestly I can't really use that term. If anything, the PT age was a perfectly example of a class truce. Simply convincing our elite to not actively be as awful as they could at every second of every day, even without an actual national project of development, was enough to precipitate the most prosperous period in our history. Too bad they went and broke the truce because they are genuinely the worst elite in the world.
The conclusion is that the traditional elite is not only not interested in development, but downright antithetical to it, up to the point of using political violence. This is far from a unique scenario, however, and in fact in few of the now industrialized countries the traditional elites championed development; arguably, only the USA, UK and maybe Germany fit this mold. In all other cases, the traditional elites had to be convinced, coaxed, bribed, strongarmed or downright exterminated, most likely a mix of several such measures. Brazilian history shows that, statistically, the odds of them getting such a project started themselves is absolute zero, the odds of them willingly joining such a project started by some proverbial Young Turks approaches zero, and the odds of them joining mostly unwillingly are virtually zero. Further, the ongoing process of despoliation of the country can only possibly make these odds even lower. QED the 500-year-old monstrosity that is our elite must cease to exist as a class for Brazil to have any hope of developing.

Foi o início dos dispositivos legais que tornariam quase impossível a alguém sofrer as conseqüências de desastres ou mesmo de crimes deliberados cometidos por companhias. A expansão do capitalismo foi predicada na limitação da responsabilidade, que, em bom português, impede que a lei penal burguesa seja aplicada aos burgueses. Aquele velho contraste das penas (ou falta das mesmas) aplicadas a trambiqueiros milionários e aqueles aplicados a ladrões de galinha.
Abusar dessas medidas é tática de negócios até hoje. A onda de
downsizing nos EUA há umas duas décadas atrás era pura rapinagem por parte de CEOs e acionistas, por exemplo. Bhopal, no quesito de responsabilidade legal de acidentes, também. E nosso amigo Trump deve toda sua fortuna à limitação de responsabilidade. O modelo de negócios dele, basicamente, era procurar alguma boa oportunidade à espera de investimento, chamar ricaços e puxar o saco deles ferozmente até convencê-los a fechar um negócio – é daí que vem sua enorme abilidade de sicofantia, uma vida inteira praticando isso. Se a oportunidade der certo, beleza, todo mundo sai gnhando. Se não, ele declara falência e fodam-se os credores, inclusive aí os otários que caíram na babação de ovo dele. Sua fortuna de centenas de milhões está protegida de suas dívidas acumuladas de mais de um bilhão. Risco de cadeia, então, nem se fala.

I guess I should make a long-overdue update on the senate enquiry about COVID.
I used to comment each days' events here, provide the schedules of each day's summons, the most important developments and sho on and sho on. The last time i did this was on the next-to-last week of the enquiry before the Congressional recess back in IIRC June, that week was arguably the peak, when the criminal organization parasitizing the healthcare ministry was laid bare. They not only deliberately hindered all efforts to contain COVID, but they also intended to profit handsomely as well when purchasing vaccines. Or even when purchasing no vaccines at all, because at least one scheme involved a supposed purchase from a scam artist, who the perps knew to be a scam artist but they didn't give a fuck because it provided an opportunity to overcharge the "purchase". Genocide for fun and profit.
The last week before recess delved into the gritty details of these transactions, and it was a shitshow. I said back then that I would comment on these events but it all piled up, because holy shit, they didn't put any effort whatsoever at disguising their crimes nor at containing their greed. They just invited all their partners in crime to join in and shit, it was so much bullshit I just lost track of it all. Preparing a fraudulent purchase in cahoots with some phony company, and then further altering the terms of that already fraudulent contract behind the company's back, some ministry worker who – according to him – was serendipitously offered millions of vaccines to purchase by random chance back when he was enjoying a beer at the mall, evangelical "charities" joining in on the pillaging, some pyramid schemes were involved somehow, even fucking bitcoins came up in that shitshow. Good luck to the historians saddled with documenting this period.
Anyway, after recess, the enquiry came back and completely lost all momentum. Although I can't say this with certainty, I think it was because they simply decided to spend all their time playing tax auditor on that scam pile-up at the healthcare ministry instead of focusing on, you know, that fucking genocide for fun and profit. Well fast-forward to last week, and they stumbled upon crimes against humanity again, so at least we get some more Spectacle to go with the genocide I guess. This time around, a private healthcare insurer who was particularly chloroquine-happy and very close to the circus' many false narratives was involved in, among other things, forging death certificates to drive the COVID death toll down, giving worthless meds to patients without their knowledge, and last but definitely not least, human experimentation of new "alternative treatments" for COVID. Mind you, this is completely unrelated to the other human experimentation which was exposed earlier this year in Manaus. I made an effortpost or two about that mess in a previous thread. Anyway much of the rogues gallery which was seen earlier in the enquiry happened to be involved again, unsurprisingly, meaning Bozo's circus was directly involved with this mess as well. Cue what I said about the criminal mentality of those atavist bastards who just waltz in and not only do whatever the fuck they want, but they also do it amateurishly and in unorganized fashion. So last week these things were uncovered, and today a journalist who collected a lot of dirt on this company will testify, so it might get interesting.
However, it's important to note that literally nothing came out of anything so far. Nothing. The circus is still committing the exact same crimes, the only difference is that they don't slap a watermark for their digital militia and their support base to jerk off to. The enquiry members on the government side still waste their allotted time in the sessions spreading the exact same lies and metaphorically shitting atop 600k graves. And the cynic in me can't help but wonder if the enquiry preferred to play tax auditor instead of focusing on the crimes against humanity on purpose, to avoid creating that atmosphere of impeachment.

A key tactic of Bozo's circus, which as far as I know came straight from Olavo, is what I call stage control, as in a theater's stage. It's not about directly controlling the crowd, since most of the crowd in question wants Bozo's blood, rather, it's about controlling where and when to use a stage. Making rehearsed public events with invited cattle to cheer on him is pat of it, naturally, and they do it almost every single day, but the principle extends beyond events with actual live audiences and includes virtually any venue visible by the public, right down to their social media accounts.
In the latter case, I have mentioned before about a common and ironclad behavior of all circus members to just say whatever dumb and false affirmations they want so long as you never
ever so much as imply that you aren't 100% correct and morally superior. This means not even acknowledging a detractor's post which itself implies they're wrong or crooks. You can insult their mothers and they might reply in kind, you might trade cringeworthy putdowns, you might even troll them into a rage, so long as you don't make an accusation they can't refute or deny. Such messages will be ignored like the plague (>implying reactoid morons wouldn't be licking rats like lollipops if they lived during the Black Plague) not just by the circus members themselves (i.e. anyone with any power or influence) but by the digital militia as well (both the paid and the hotpocket keyboard warriors). Some bots might engage such messages because discerning content like that is way past the ir (current) capacity – semantics will always be AI's weak spot. But not a single
person undetermined biological entity will do it. These messages are completely derelict, sandwhiched in between other replies which make no such accusations and receive plenty of, if not answers, at least like, reblogs and whatnot.
When it comes to the blatant crimes the circus commits every single damn day, this tactic extends beyond them and encompasses the State actors who should and, in a sane world, would be slapping their shit. Take the head of the House, for example, the most crucial of all offices because he alone decides whether a motion to impeachment is started at all. This year, Bozo sucessfully installed a full-on accomplice in that office who is currently sitting atop 132 such motions and counting (

Given both the brazenly open aspect of these crimes and their sheer volume, the primary tactic simply has to be to ignore the subject. On the internet, this is dead easy, he just plain never replies to accusative messages (like most public personalities do anyway) and obviously he never brings the topic himself.
In person, however, this takes some effort. One of the nuances of dealing with old media is that, unlike with social networks serving as fully impersonal medium, there's always a physical party there making the questions, which, in any State which pretends to be a democracy, adds some pressure for the questioned party to reply in the name of accountability. Although the person might choose to not acknowledge like they do on social networks, this reflects badly on him because a question made in person and in public is the only way they cannot claim ignorance with any plausible deniability – always keep this concept in mind, it's essential in modern politics. Although the head of the House (or any of his other accomplices, for that matter) cannot be commandeered into fully friendly public outings like Bozo can, he is under incomparably less scrutiny, especially by the people. The overwhelming majority of his declarations are made to the press and, obviously, the House, and the key point between those two entities is that both are strongly pressured to be docile or at least polite. In the House, his adversaries can bring up his partnership-in-crime with Bozo, but it's not common, and anyway, it has no credence, because politicians say the most false, not to mendion dumb, shit ever. The press, which putatively has a duty to hold these people accountable, is tamed by a myriad ways and almost never speak truth to power. A couple of examples for the sake of argument: previous selection of docile journos by media corporations in bed with the government, and the deliberate misinterpretation of the notion of objectivity as simply working as a loudspeaker to lies and slander. Ultimately, bigshots like the head of the House will almost never be asked the important questions, and virtually never be asked in a candid way which doesn't allow them to squirm away. In this case, the head of the House will never hear "the president's son, an elected member of the House, broke this-and-that law in that-and-this occasion in front of the cameras, when will you enforce the rules so-and-so of the House and suspend him?" This would be
actual objectivity, a statement of fact in demand of an appropriate response, and not an opportunity to take his lies at face value. This only might happen when random people crash his public outings, whether at official events on during personal time, and either way, this is considered even less legitimate than being questioned by Representatives. At most, opposition media mention such episodes as "so-and-so was confronted by protestors" or "was hecked in public".
This part of stage control, obviously, is much older than Bozo's non-existant Nazi gramps. Nonetheless, it showcases another key tactic of the "new" right, which is to abuse the safeguards and wiggle room deliberately built into any bouegie democracy. Up until recently, these were supposed to be used sparingly with the goal of preserving class dictatorship and its disguise of democracy, but the trissomic fascists make use of them with wild abandon, much to the chagrin of the more progressive porkies. In effect, this replaces the coordinated process of hypernormalization with a chaotic omninormalization, on which I have expounded several times before. These mechanisms are many and well worth several books of analysis I think, so I'll just point out now that they're not at all restricted to the bougie State itself. Mass media is, after all, an integral part of class dictatorship, and even tho it's nominally independent of the State in a farcical bourgeois democracy, the shared class control takes care of things. The aforementioned docility of journos in key positions and the crass misinterpretation of objectivity are two such mechanisms. Americans have elevated media relations to a science, built as it is on the pretense of democracy, so they provide the most and richest examples of these mechanisms.

The circus' latest talking point is Bozo ending federal tax(es?) on cooking gas. This takes a whopping R$ 2.18 out of a price of over R$ 100. In the same vein, the day after the Petrobrás president said there would be no aid for impoverished families to buy gas (>>517631), the circus announced a program for exactly that. They made a big deal about it (as they always do), touting the sum of R$ 300m in subsidies during the next 15 months to lower the price of gas canisters for families on welfare (Bolsa-Família, specifically). However, if all enrolled families take part in it, the price would go down by a whopping-er R$ 1.56. The insane fuel prices are all thanks to a decision taken by Temer in October 2016, a bit over a month after the impeachment, for Petrobrás to trade hydrocarbons internally using the global, dollar-set price, instead of a lower price aimed at making these products affordable. In practical terms, hydrocarbons' final market prices are directly set by the exhange rate. Even more so than everything else, since changes in the exchange rate tend to have wide-reaching effects in the economies of underdeveloped nations. And as it happens, the exchange rate, already volatile thanks to Car Wash, keeps falling under Paulo Guedes. Ostensibly, this isn't deliberate, but he gave the game away in early 2020, mentioning the rate was too high soon before it nosedived for good. Where does these exploitative fuel prices go? Weeks ago, Petrobrás announced a R$ 31.6b dividend payout – it's a partially private company, after all. If it wasn't, it would have no incentive to drive the price upwards as it does now, but nevermind that dirty lil secret, because Paulo Guedes said the intention is to sell it all off in 10 years. Dória promised the same if elected, altho he didn't provide any deadlines.

A core trait of the trissomic right is how completely devoid of merit they are, both on a political and personal level. This full-spectrum cretinism is also seen in the failure of our virtually all of our institutions, as well as in the complete worthlessness of the liberal economic project. In here no one of us nurtures any illusions as to the retrograde goals of liberal economics, however, its enactment has shown that it has no positive points whatsoever. It's not just a net negative, it's a complete loss. There's no aspect of it whatsoever worth keeping, as far as I can see. Privatizations, the biggest demand of the clerics of the neoliberal church, has a very, very patchy history when it comes to impriving services, especially here. The single case which they always claim as a success is telecomms, and even that absolutely requires context, which they never provide, assuming they even know it. Although there was, unquestionably, an improvement in the market's products and services, it has two very significant asterisks attached in front of it.
One of them is that the State monopoly of Telebrás which was ended with the (partial) privatization was indeed awful, although not as in it could have done better if it had profit motive, but in that it was hobbled by necessary government investment elsewhere. I can't say whether it was itself mismanaged or not, but one thing I can tell you for a fact is that it simply could not have done a proper job even if it was because the very nature of telecomms requires a lot of infrastructure investment, especially in the initial laying of immense lengths of cabling. Precisely the sort of thing which only States can properly do – and which wasn't getting done, unsurprisingly. Wiring up a country is a national project, and our elite (the worst one in the world, I'll keep repeating to my dying breath) has always loathed these sorts of things. It traditionally views fundamental investments like this not as investments at all but simple expenditure, as it does investments in healthcare, education and all other areas at the very base of any modern developed society. This is not borne of liberalism however, this is symptomatic of a comprador elite, especially one as anomaloussly long-lived as ours. A lot more can be said about this so I'll finish the Telebrás case first. Besides the crass mentality of our elite, the government at the time enforced austerity hell. So that State monopoly was fated to fail at its job that to systemic issues well beyond its scope. The result: at a time when the global average time on a waiting list for a landline was less than 1 year (
https://www.itu.int/ITU-D/ict/publications/wtdr_98/WTDR98_e_chap2.pdf), in Brazil, the wait lasted 2-5 years, and the payment was made upfront to boot. It was no surprise this particular State monopoly didn't have many apologists back then. It was broken and companies were privatized with some clauses which mandated the buyer to invest certain sums expanding the infrastructure, a job which the State refused to do.
The low quality of service at the time of the end of the State monopoly was contrasted with a surprisingly quick expansion of services, specially mobile phones. Telecomms privatization in Brazil happened to take place right at the start of a huge telecomms boom led by cellphone markets, which is the second caveat to the success of telecomms privatization in Brazil. Maybe you're connecting the dots already; the greatest problem was the lack of infrasctruture thanks to omission by the State to laying the all-important cable grid across a vast territory, so mobile telecommunications was perfect to fill the niche. Requiring much less physical infrastructure to be installed and maintained, cell networks could spread much more quickly, and I guess that this cheaper cost to the companies at prices similar to those of landlines made for higher profit margins as well tho this is a supposition of mine. Anyway, this quick expansion, which liberals and reactionaries in general credit only to the private companies (or maybe they actually think so too) was enabled by a quirk of technology. These game-changing (an overused word nowadays) events are rare, unpredictable and irreproducible, but alas, it coincided with privatization here so the bourgeoisie is glad to steal the credit, among other things. The great mobile boom, it should be noted, applied to the availability of phone lines, but not necessarily to their quality. Ever since Telebrás' monopoly was broken, phone companies have consistently remained atop the lists of companies with the most complaints lodged with the official consumer protection office, Procon. As is typical here, their services have little bang for our buck to to various factors related to underdevelopment, such as the still-insufficient infrastructure, government telecomms agency being a bit too forgiving to these companies, occasional spikes in exchange rates, porkies gobbling up the savings when there are tax reductions instead of passing them on etc. etc. Although, to be fair, Telebrás and its subsidiaries couldn't have possibly received too many complaints at Procon seeing as their product was hardly even existant at all, so God knows what their quality would be if the monopoly were still on during the mobile boom.
So there's a rebuttal for the single success case which liberals can summon for privatizations here. Feel free to rub it in their faces when the occasion comes. Now, a rant about the worst elite in the world. Why shell out a fortune to build an industrial complex which will bear fruit years in the future when you can just buy industrialized goods from outside and sell them here at a markup today? Not only it takes no effort nor know-how, but being a middleman also has a much higher turnover rate – which is profitable for the comprador elites, and terrible for everyone else. Foreign intervention notwithstanding, the fault with any country's underdevelopment falls squarely on the shoulders of its ruling class, and if that is comprador, the country is doomed to underdevelopment simply because that elite's material interests directly clash with those of the country at large. It's not a conspiracy but rather simple class interests, and explaining this is not witch-hunting but a simple statement of fact at which one arrives once asking themselves
