I'm not a copyright lawyer, but you can create whatever you want. Commercialization and distribution is the problem.

Well that's the point of copyright, to suppress creativity and the flow of culture–in any field, not just music. Music is just among the most obvious examples. Copyrighting a sequence of notes is like copyrighting colors, as Pantone does.

Folk culture competes with private works, so it is in the interests of the holders of copyrighted works to disrupt that.

If you can copyright as many sequences of notes as possible, then you can reduce the chances that people will be listening to some independent work or a competitor by making the composition process a minefield.
