No he isn't, you're conflating people who sell services as freelancers (the people referred to in that first passage) with people who sell their labour power to a capitalist. Its the difference between a private gardener hired directly by a property owner versus an employee of a landscaping company. That is the central relation that makes somebody a productive labourer, and crucially what lays the basis of their antagonism to capitalists and the capitalist system. What the capitalist does with that labour power after they purchase it is irrelevant, so long as they are extracting surplus value. If we follow your logic we are led to all kinds of absurd conclusions, mainly that somebody can have the exact same relationship to the capitalist and the capitalist system but for some reason not be considered a worker because their labour power is used for something other than producing physical commodities. How do the class interests of a retail worker differ from those of a factory worker?

That's still not the point. Whether or not a person is productive or not has nothing to do with the use values that result from their labour. In fact this is specifically the notion that Marx argues against. Unfortunately people have no reading comprehension and can't actually follow what he's saying, or else they are projecting the modern ways in which some professions function onto the 19th century when they worked differently (e.g. taking a quote referring to a freelance private tutor and applying it to modern public school teachers). He says specifically and in no unclear language that productive labour is defined by the production of surplus value via selling labour power to a capitalist. This is the only definition that makes any sense, since otherwise you would need to explain how a retail worker is any less of a class enemy of their employer when compared to a factory worker. Whether the doctor in your example creates a use value with their labour is irrelevant then, the question is whether they produce surplus value through the sale of labour power.
